Motor Vehicle Accidents

Motor vehicle accidents can change your life dramatically and will have an impact on your loved ones. It is necessary for you to seek medical attention immediately and report the accident.

You are required to contact your insurance company within 7 days.

There are two sources of compensation in a motor vehicle accident which the injured party may receive.

All injured parties in a motor vehicle accident are entitled to receive Accident Benefits from their insurance company regardless of fault, these are known as "no fault" benefits. An application for Accident Benefits should be filed as soon as practically possible with your insurance company as time limits exist. The parties may receive such benefits as:

  • Other Expenses
You can pursue a tort claim against the "at-fault" driver if you injuries reach a threshold. The injured party is entitled to commence a tort claim within 2 years from when you could have reasonably discovered that you had a claim. Types of damages you may be eligible are:
  • Pain and Suffering;
  • Lost income;
  • Loss of Competitive Advantage in the Labour Market;
  • Medical Treatment;
  • Housekeeping and Home Maintenance Expenses; or
  • Claims for family members under the Family Law Act for loss of care guidance and companionship from the injury or death.
